Last Updated: October 22nd<\/sup>, 2025<\/strong><\/p>\n This\u00a0Washington Resident Privacy Notice (\u201cWashington Notice\u201d) provided by the fitness centers (\u201cFitness Centers\u201d or \u201cwe\u201d or \u201cour\u201d) owned or operated by Premise Health Employer Solutions, LLC (\u201cPremise Health\u201d) supplements the information contained in our Fitness Center – Privacy Policy<\/a> (\u201cPrivacy Policy\u201d or \u201cPolicy\u201d), and our Fitness Center – State Privacy Law Addendum<\/a> (\u201cAddendum\u201d).<\/p>\n If you are a Washington resident that visits the Fitness Centers, the information below may apply to you.\u00a0 This Washington Notice describes consumer rights under the Washington My Health My Data Act (\u201cMHMDA\u201d) and explains how to exercise those rights. The MHMDA protects information that is linked to or is reasonably linkable to an identified or identifiable consumer and reveals their physical or mental health status (\u201cConsumer Health Data\u201d).\u00a0 Consumer Health Data does not<\/u> include information that is de-identified or publicly available or certain regulated research data.<\/p>\n The MHMDA and this Washington Notice do not<\/u> apply to Member health information we maintain in accordance with the Health Insurance Portability and Accountability Act and its implementing regulations (\u201cHIPAA\u201d).\u00a0 That information is governed by the Notice of Privacy Practices<\/a>, which is available at the Privacy & Compliance Policy Center<\/a>.\u00a0 The MHMDA excludes other categories of information that we do not list here.<\/p>\n Any terms defined in the MHMDA have the same meaning when used in this Washington Notice.\u00a0 To the extent there is any inconsistency between the Privacy Policy<\/a> and this Washington Notice, the terms of this Washington Notice apply.<\/p>\n Consumer Health Data We Collect, Use and\/or Disclose <\/strong><\/p>\n The categories of Consumer Health Data we may collect, how we may use that Consumer Health Data and the categories of third parties to whom we may disclose\/share that Consumer Health Data are included in our Privacy Policy<\/a>.<\/p>\n We may also collect, use and disclose the following categories of Consumer Health Data if a Fitness Center member provides such Data to a fitness coach: (i) social, psychological, behavioral, and medical interventions; (ii) bodily functions, vital signs, symptoms, or measurements; and (iii) data that identifies a member seeking health care services.<\/p>\n As noted in our Privacy Policy<\/a>, we may collect this Consumer Health Data directly from you or our clients (e.g., employers).<\/p>\n Your Right to Know<\/strong><\/p>\n You have the right to know whether we are processing your Consumer Health Data.<\/p>\n Your Right to Access<\/strong><\/p>\n You have the right to access and obtain a copy of the specific pieces of Consumer Health Data we have collected about you, upon verification of your identity.<\/p>\n Your Right to Correct<\/strong><\/p>\n You have the right to request that we correct inaccurate Consumer Health Data that we collected and maintain about you.<\/p>\n Your Right to Request Deletion<\/strong><\/p>\n You have the right to request that we delete the Consumer Health Data that we collected from or obtained about you, subject to certain exceptions under the law.\u00a0 Once we receive and confirm your identity, we will delete (and direct our service providers to delete) your Consumer Health Data from our records, unless an exception applies.<\/p>\n Your Right to Withdraw Consent<\/strong><\/p>\n You have the right to withdraw your consent to the collection and sharing of your Consumer Health Data.<\/strong><\/p>\n Your Right Not to Receive Discriminating Treatment <\/strong><\/p>\n You have the right not to receive discriminatory treatment for exercising any consumer rights described in this Washington Notice or the MHMDA.<\/p>\n How to Exercise Your Rights<\/strong><\/p>\n To exercise any of the rights noted above, you may contact us at: Privacy@premisehealth.com<\/a> or via our toll-free phone number (844) 407-7557.<\/p>\n We may ask you to provide additional personal information, such as your name and email, so that we can properly identify you in our dataset to track compliance with a request. We will only use personal information provided in a request to review and comply with the request. If you choose not to provide this information, we may not be able to respond to your request if we cannot verify your identity (or your authority to make the request for someone else). In certain circumstances, we may decline a request to exercise the rights described above.<\/p>\n You may designate an authorized agent to exercise your rights on your behalf.<\/p>\n Our Response<\/strong><\/p>\n We will try to respond to a verifiable consumer request within forty-five (45) days of receipt. If we are unable to process your request in such time, we will inform you of the delay in writing by mail or email.\u00a0 Information provided in response to a consumer request will be provided free of charge up to twice annually.<\/p>\n If a request is manifestly unfounded, excessive or repetitive, we may charge a reasonable fee to cover the administrative costs of complying with the request or may decline to act on the request.\u00a0 If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request.<\/p>\n Your Right to Appeal<\/strong><\/p>\n If we are unable to comply with all or a portion of your request, we will explain the reasons we cannot comply.
